These Terms and Conditions ("Terms") govern your relationship with the online gaming operator that provides access to the Captain Cooks casino brand to Canadian residents via the Captain Cooks environment on captain-play.ca (the "Website") ("Operator", "we", "us", "our"). These Terms are effective from 1 January 2026 (last reviewed for validity through 31 December 2026) and apply to all real-money play, bonuses, and related services ("Services").
For players located in Ontario, the Operator is Apollo Entertainment Ltd., licensed and regulated by iGaming Ontario ("iGO") and the Alcohol and Gaming Commission of Ontario ("AGCO"). Definitions
- Operator means, as applicable: (a) Fresh Horizons Ltd. for players in Canada outside Ontario under Kahnawake Gaming Commission oversight; or (b) Apollo Entertainment Ltd. for players in Ontario under iGO/AGCO oversight. Both entities are privately held limited companies; corporate registration numbers, tax identification numbers, and bank details are not specified in this document.

- Prohibited Jurisdictions means any country or territory where online gambling with the Operator is illegal or where the Operator chooses not to accept players, including, without limitation, the United States of America and Australia.
- Device means any computer, mobile phone, tablet, or other hardware you use to access the Website or Services.
Account Registration
Eligibility and Age Requirements
- Minimum age: You must be at least 18 years old and also meet or exceed the minimum legal gambling age in your province or territory of residence (which is 19 in Ontario and most other Canadian provinces). Where the applicable legal age is higher than 18, the higher age applies.
- Location: You must be physically located in a jurisdiction where participation in online gambling with the Operator is lawful. Players from the USA, Australia, and other Prohibited Jurisdictions are not permitted to register or play.
- Ontario vs rest of Canada: Ontario residents must access the Services only via the Ontario-regulated brand platform (for example, captaincooks.games or redirections from casinorewards.com) as listed on the iGO operator directory at igamingontario.ca. Residents of other Canadian provinces use the KGC-regulated platform (for example, captaincooks.casino).
Registration Process and Verification (KYC)
- Account creation: To open an Account you must complete the online registration form, providing accurate and complete information including your full legal name, date of birth, residential address, email address, and any other details requested by the Operator.
- Email and phone verification: We may require you to verify your email address and/or mobile number through a verification link or code sent to you. Access to some Services may be restricted until verification is complete.
- Know Your Customer (KYC): Before allowing deposits, gameplay, or withdrawals, we may request documents such as government-issued photo ID, proof of address, and payment method ownership. Documents must be clear, valid, and belong solely to you.
- Ongoing verification: We may conduct additional checks at any time, including when your cumulative deposits or withdrawals reach certain thresholds, where required by anti-money-laundering (AML) regulations or our internal risk policies.
User Obligations and Account Security
- Accuracy of data: You are responsible for ensuring all registration details and documents provided are true, accurate, and up to date. You must promptly notify us of any changes and may be asked to provide evidence of updated information.
- Single account: You may hold only one Account with the Operator for the Captain Cooks brand in each applicable jurisdiction. Duplicate accounts, including those using different email addresses or identities, are prohibited and may be closed, with bonuses and winnings voided.
- Credentials: You must keep your username, password, and any security details confidential. You are responsible for all activity on your Account unless we have confirmed in writing that your Account has been compromised and secured.
- Device and network security: You must take reasonable steps to secure your Device and internet connection. Use of shared devices or public networks is at your own risk.
- VPN and location spoofing: The use of virtual private networks (VPNs), proxies, or any technology intended to conceal or falsify your true location is strictly prohibited. If we reasonably believe that you have used such tools, we may suspend or close your Account, void bets, and confiscate funds derived from prohibited play.
- Prohibited persons: Employees of the Operator, certain contractors, and persons otherwise prohibited by the Operator or regulators may not open an Account or participate in the Services, except as explicitly authorized for testing purposes.
Betting & Gameplay Rules
General Gameplay Conditions
- Game rules and RNG: All games are provided by licensed software providers and use random number generators (RNGs) independently tested and certified (including by eCOGRA as of 2026). The outcome of each game is determined by the relevant RNG and/or game mechanics as displayed within the game. In the event of any discrepancy between game outcomes shown on your Device and the Operator's servers, the records on the Operator's systems shall prevail.
- Minimum and maximum bets: Each game has its own minimum and maximum bet limits, as shown in the game interface or paytable. You must ensure your bets are within these limits. We may also impose Account-level or jurisdiction-level limits in line with responsible gambling obligations and regulatory requirements.
- Placing a bet: A bet is deemed placed and accepted when it is registered on the Operator's servers and appears in your transaction history. If a bet is not confirmed due to technical failure, it is not considered valid.
Bet Cancellation, Errors, and Malfunctions
- Cancellation by you: Once a bet has been accepted and the game has commenced, you may not cancel or amend the bet.
- Operator corrections: We may void or correct bets and game outcomes where: (a) a clear technical error or malfunction occurred; (b) the game or payout was misconfigured; (c) the bet was accepted after the outcome was known; or (d) the bet was placed in breach of these Terms. In such cases, our responsibility is limited to refunding the original stake or restoring the balance to its state immediately prior to the erroneous transaction.
- Malfunction clause: In the event of a malfunction of the game or communications systems, all affected bets and payouts are void. Stakes may be refunded to you at our discretion, subject to regulatory requirements.
Conduct, Live Casino, and Chat
- Fair play: You must not engage in any fraudulent or unfair behavior, including but not limited to collusion with other players, exploitation of software bugs, use of bots or automated tools, advantage play schemes designed to circumvent game rules, or any other conduct that provides an unfair advantage.
- Live casino etiquette: In live dealer games, you must comply with the instructions of dealers and staff at all times. Offensive language, harassment, disruptive behavior, or attempts to influence game outcomes unlawfully are prohibited.
- Chat rules: Where chat functionality is available, you must not post content that is abusive, defamatory, obscene, racist, sexist, discriminatory, threatening, promotional, or spam. You must not solicit other players or promote other websites, products, or services.
- Monitoring: We may monitor and record gameplay and chat communications for security, regulatory, and quality-assurance purposes. Breaches may result in warnings, chat bans, Account suspension, or permanent closure, with forfeiture of bonuses and, in cases of fraud, of winnings.

Bonus Terms
Bonus Eligibility and Activation

- Maximum bet while wagering: There may be a maximum bet per spin or game round while a bonus is active. Exceeding this limit may be considered bonus abuse, and we may void the bonus and associated winnings.
- Multiple accounts and household use: Using multiple Accounts, Devices, or payment methods within the same household or network to claim the same promotion repeatedly is strictly prohibited.
Combining Promotions and Bonus Management
- Non-stacking rule: Unless expressly permitted, only one active bonus may be in play at any given time. New promotions may require completion or cancellation of existing bonuses.

Refunds, Chargebacks, and Reversals
- Deposits: Deposits are considered final once confirmed. We are not obliged to refund deposits or reverse valid bets merely because you have changed your mind, failed to use the funds, or lost the funds during gameplay.
- Chargebacks: You must not request chargebacks or reverse payments without legitimate cause. If a chargeback occurs, we may suspend or close your Account, void bets and bonuses, and recover outstanding amounts. We may also inform relevant regulators and payment providers.

- Fairness and integrity: The Operator is committed to providing a fair, secure, and transparent gaming environment. Games use independently tested RNGs and are subject to auditing by bodies such as eCOGRA (certification active as of 2026). The Operator complies with applicable regulations and permit conditions set by the KGC, iGO, and AGCO, as relevant.
- Accuracy of information: We take reasonable care to ensure that the information on the Website (including Captain Cooks content on captain-play.ca) is accurate and up to date. However, minor errors or omissions may occur, and official rules and paytables within each game take precedence.
Exclusions and Limitations
- Technical issues: We are not liable for any loss, costs, or damages resulting from failures of your Device, internet connection, telecommunications systems, or third-party software. If a game or transaction is interrupted due to technical issues on our side, we will endeavor to restore the game state where feasible or otherwise refund the stake.
- Indirect losses: To the maximum extent permitted by law, we are not liable for any indirect, consequential, or special damages, including loss of profits, loss of data, or loss of opportunity, arising out of or in connection with your use of the Services.
- Bet-related cap: In respect of any individual bet or game round, our maximum liability to you, whether arising in contract, tort, or otherwise, shall not exceed the amount of the stake placed by you in that bet or game round, or the amount of funds in your Account at the time the relevant issue occurred, whichever is lower.
- Regulatory variation: Some jurisdictions, including certain Canadian provinces, do not allow the exclusion or limitation of certain types of liability. In such cases, the limitations in these Terms apply only to the extent permitted by applicable law, and your statutory rights remain unaffected.
- Private entities: Fresh Horizons Ltd. and Apollo Entertainment Ltd. are private companies and do not publish public financial reports or stock market filings; no representation is made regarding their financial strength beyond regulatory licensing and certification requirements.
Intellectual Property Rights
Ownership
- Content and software: All intellectual property rights in and to the Website, the Captain Cooks brand as presented via captain-play.ca, the Casino Rewards group branding, software, source code, graphics, logos, text, sound, video, and other materials (collectively, "Content") are owned by the Operator, its group companies, licensors, or partners.
- Limited license: You are granted a limited, non-exclusive, non-transferable license to access and use the Website and Services on your Device for personal, non-commercial entertainment purposes only, strictly in accordance with these Terms.
Restrictions
- No unauthorized use: You must not copy, reproduce, distribute, publish, broadcast, modify, reverse engineer, decompile, disassemble, translate, sell, sublicense, or otherwise exploit any part of the Content or software without our prior written consent.
- No data scraping: You must not use any automated tools (including robots, spiders, scripts, or scrapers) to access, monitor, or extract data from the Website or Services.
- Third-party marks: All third-party trademarks, service marks, and logos are the property of their respective owners and may not be used without permission.
Privacy & Data Protection

Changes to Terms
Amendments and Updates

Acceptance of Changes

- Right to discontinue use: If you do not agree with any updated Terms, you must stop using the Services and may request closure of your Account in accordance with the Termination & Suspension section. In such cases, your remaining Real Money Balance will be returned to you, subject to regulatory checks, pending bets, AML obligations, and any right we may have to withhold funds due to breach.
- Precedence: In the event of any inconsistency between these Terms and any terms displayed on specific brand domains (such as https://captaincooks.casino/en/terms/), the terms applicable to the jurisdiction and platform on which you are playing will prevail to the extent of the inconsistency.
Termination & Suspension
Termination by You
- Account closure: You may request closure of your Account at any time by contacting customer support through the methods provided on the Website or within the casino interface. We may offer options such as temporary breaks, self-exclusion, or permanent closure.
- Remaining funds: Upon closure requested by you (other than for self-exclusion), we will, subject to AML checks and regulatory requirements, pay out your Real Money Balance (excluding any Bonus Balance or funds derived from bonus abuse) to you via an agreed withdrawal method.
Suspension or Termination by the Operator
- Grounds: We may suspend or terminate your Account, freeze funds, void bets, and/or confiscate bonuses and winnings where we reasonably believe that:

- you are under the legal gambling age or have provided false or misleading information;
- you are located in, or using a VPN or other tools to appear located in, a Prohibited Jurisdiction (including the USA or Australia);
- you have engaged in fraud, collusion, money laundering, terrorist financing, chargebacks, or other unlawful or suspicious activity;
- you have multiple or duplicate Accounts;
- you have abused bonuses or promotions; or
- we are required to do so by a regulator or law enforcement authority.
- Consequences: In cases of suspected breach or illegality, we may withhold all or part of your funds pending investigation. If a breach is confirmed, we may retain funds to the extent necessary to cover damages, costs, or chargebacks, and may forfeit bonuses and associated winnings.
- Inactivity: We may classify Accounts as inactive after a prolonged period of no login (for example, 12 consecutive months) and may charge a reasonable inactive account fee, where permitted by law, up to the amount of the Real Money Balance. You will be notified by email or other reasonable means before such fees are applied.
Notification and Appeals
- Notice: Where legally permitted, we will notify you of the suspension or closure of your Account and the reasons for such action, using your registered email address or in-Account messaging.
- Appeals: You may contact customer support if you believe your Account has been closed or restricted in error. If you remain dissatisfied after exhausting our internal complaints procedure, you may escalate the matter to the appropriate regulator or ADR provider in accordance with the Governing Law & Jurisdiction section.
Governing Law & Jurisdiction
Applicable Law
- Ontario players: For residents of Ontario playing on the Ontario-regulated platform, these Terms and your relationship with the Operator are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Your participation is additionally subject to the regulatory framework administered by iGaming Ontario and the Alcohol and Gaming Commission of Ontario.
- Rest of Canada (non-Ontario): For residents of other Canadian provinces or territories playing on the Kahnawake-regulated platform, these Terms and your relationship with the Operator are governed by the laws of the Mohawk Territory of Kahnawake and, where applicable, the federal laws of Canada. Online gaming in these provinces may operate in a so-called "grey market" where local licensing frameworks are still evolving but KGC-permitted operators are generally tolerated.
Dispute Resolution
- Internal complaints: If you wish to make a complaint, you must first contact our customer support team, providing full details of the issue (including relevant screenshots, transaction IDs, and dates). We will acknowledge receipt and aim to resolve your complaint as promptly as reasonably possible.
- Alternative Dispute Resolution (non-Ontario): If you are not satisfied with our final response and you are playing under KGC jurisdiction, you may refer your complaint to an approved ADR provider such as eCOGRA. - Court jurisdiction: Subject to any mandatory ADR or regulatory processes, any dispute arising out of or in connection with these Terms may be brought before the competent courts of: (a) Ontario for Ontario-regulated play; or (b) the Mohawk Territory of Kahnawake for KGC-regulated play, without prejudice to any rights you may have to bring proceedings in your local courts where such rights cannot be excluded.
